Exemptions

The definition of “motion picture distributor” does not include the government of BC or Canada. Classification requirements do not apply if a motion picture is being screened under the auspices of the government of BC or Canada.

Universities, colleges or other educational institutions may be exempt from classification if they are showing a motion picture for educational purposes.

Film societies may be exempt from classification if they meet certain criteria and apply for the exemption. Application forms may be requested at classadmin@consumerprotectionbc.ca

To be exempt, film societies must meet the following criteria and apply for the exemption:

• a non-profit cultural organization registered with BC’s Corporate Registry
• a mandate to encourage and appreciate motion pictures as a medium of art, information or education
• screenings only to members who are at least 18 years of age

Canadian films approved by the Canadian Audio-Visual Certification Office (CAVCO) or Canadian Radio-Television and Telecommunications Commission (CRTC) for tax credit purposes may be eligible for a waiver of BC theatrical classification fees only.

To apply for a fee waiver under CAVCO or CRTC, you must meet all the following requirements:

• Be licensed as a motion picture distributor;
• Submit a Screening Request Form indicating that your film has been approved by CAVCO or CRTC for tax credit purposes;
• Present a CAVCO or CRTC Certificate for the motion picture.
