Summary:

Scotiabank is a financial institution, also known as the Bank of Nova Scotia. Consumer Protection BC investigated the business practices of Scotiabank following a consumer complaint regarding credit checks.

Consumer Protection BC held a hearing on allegations the business violated consumer protection laws. It found the company did not get consent from the consumer before performing a credit check for a business credit card, violating section 107 of the Business Practices and Consumer Protection Act.

Scotiabank is ordered to change its procedure for issuing business credit cards to let the person applying for the card know their credit will be checked. The consumer must signify or acknowledge their consent in a record made at the time.

Scotiabank must reimburse $4040 to Consumer Protection BC for the inspection cost and pay an administrative penalty of $2500 into the Consumer Advancement Fund.
