Cemetery and Funeral Preneed Information

Section 10 of the Consumer Contracts Regulation requires a licensee to submit annual financial statements in respect of each preneed cemetery or funeral services contract for the previous fiscal year within 90 DAYS of their fiscal year end.  To submit your financial information please select the login option on the top right hand corner of this screen.  

Please note that a late filing charge applies for incomplete or late submissions received after the due date.  Also, Financial Declarations that do not meet the requirements will be returned as incomplete and not recorded as received.

Below is a list of the definitions and explantion of the information required.  

Name of the Applicant” is the full, legal name of the applicant registered with the BC Corporate Registry.
Cemetery” means land that is set apart of used as a place of burial of human remains or cremated remains and includes any incidental or ancillary buildings on the land.
Cemetery Services” means the operation of a place of interment or crematorium and the disposition of human remains by interment or cremation and includes the supply of goods incidental to and as a part of interment or cremation, but does not include the sale of rights of interment.
Crematorium” means a building or a part of a building used for the purpose of cremating human remains and includes appliances and other equipment incidental or ancillary to that purpose
Funeral Provider” means a person who carries on the business of providing funeral services
Funeral Services” means
(a) Arrangements and services related to the interment or cremation of human remains,
(b) Care and preparation of human remains for purposes related to paragraph (a),
(c) Bereavement rites and ceremonies, and
(d) The supply of goods incidental to and as part of the arrangements, services, care preparation and bereavement rites and ceremonies referred to in paragraphs (a) to (c),
But does not include the sale of rights of interment or the disposition of human remains by interment or cremation
Licence number” is the number assigned by Consumer Protection BC when the applicant was first approved for a licence, which remains unchanged from year-to-year.
Director” means a director under the Business Practices and Consumer Protection Act.
“Preneed cemetery or funeral services contract” means a contract that provides for cemetery or funeral services for one or more person who are alive at the time the contract is entered into.
Preneed Trust Account” means funds received as part of a preneed cemetery or funeral services contract and which are on deposit in a savings instition account formally designated by the institution as a trust account;
Trustee” is a savings institution

(A)
declarant’s name” is the person authorized to speak for the applicant and who will swear the information included in the declaration
(B) declarant’s relationship to the applicant” is the nature of the legal or employment relationship between the declarant and the applicant that affords the declarant to have personal knowledge of the information sworn
(C ) “fiscal year” is (usually) the 12-month period selected by the applicant for reporting its financial operations.  If the applicants changed its fiscal year end during the past year, the period will be from the last fiscal year end before the change to the date the fiscal year end was changed to and will be less than 12 months;
(D)Opening Balance” is any amounts received, or held, in relation to the contract immediately before the beginning of the fiscal year
(E) Total purchase price is for the goods or services supplied, or to be supplied, under the contract including PST/GST. 
(F) Total new preneed sales is any amounts received, or held, in relation to the contract during the fiscal year and any amounts placed in the preneed interim account in relation to the contract during the fiscal year
(G) Total interest credited is any interest credited to amounts placed in the preneed trust account in relation to the contract during the fiscal year
(H) “Total amount paid out as contract converted to At Need” is any amounts paid out by the trustee in relation to the contract regarding ‘At Need’ goods or services supplied during the fiscal year
(I) “Total amount paid out as preneed contract cancellations” is any amounts paid out by the trustee in relation to the contract regarding preneed contract cancellations during the fiscal year 
(J) “Total amount paid out” is any amounts paide out by the trustee in relation to the contract during the fiscal year
(K) “Closing Balance” is the balance in the preneed trust account in relation to the contract at the end of the fiscal year
