Contract Cancellation

There are several circumstances in which you can cancel your contract. You can cancel your contract within 10 days of receiving a copy of your contract. After 10 days, you can cancel either due to a material change in your circumstances or a material change in the circumstances of the supplier.

The first step is to provide notice of cancellation. There are several ways in which cancellation can be given including regular mail, registered mail, email, by fax or delivery in person. Consumer Protection BC recommends that you keep proof that your notice of cancellation was delivered.

Cancelling Within 10 days of Receiving A Copy of Your contract

You can cancel a contract within 10 days of receiving a copy of your contract for any reason. If you are cancelling within 10 days of receiving your contract you can complete a form here.

Cancelling a Contract Due to Material Change in Your Circumstances

If you are cancelling due to a material change in your circumstances, you must provide proof that supports your claim.

  • For a cancellation due to medical reasons this would include a note from a medical or nurse practitioner showing that you are unable to continue with your membership due to a physical, medical or mental disability.
  • If you are cancelling because you have moved more than 30km from the facility and the facility does not provide reasonably comparative facilities within 30 km of your new location, you must provide proof of your new address.

Cancelling a Contract Due to Material Change in the Supplier

If you are cancelling due to a material change in the supplier, for instance if the business has shut down, you should cite material change in the services provided by the supplier as the reason for cancelling.

Refunds

If a refund has not been received after 15 days of giving notice of cancellation you can contact Consumer Protection BC to make a formal complaint, complete a complaint form here. When making a complaint you are required to provide a copy of your original contract, a copy of the cancellation request and any additional information provided such as proof of material change in your circumstances.
