{November 8, 2010} - BURNABY BC - Under the Motion Picture Act, the definition of “film” includes pre-recorded motion pictures. Distributors are required to submit for classification all pre-recorded films. Theatres must ensure that all of their exhibited films have been classified by Consumer Protection BC. Pre-recordings of concerts and plays meet the definition of film regardless of whether they were performed in front of an audience. These must be classified. Only when the performance is simultaneously broadcast from its location to a BC theatre is it not within the scope of the Motion Picture Act. In this circumstance, the performance or sporting event is occurring at exactly the same time as it is broadcast in a BC theatre. Although these broadcasts are not required to be submitted to Consumer Protection BC, any encore screenings do require a classification. “Time-delayed” exhibitions are deemed to be pre-recorded films and must be submitted for classification.
